1. How many employees must you have before you come under the provision of the Wage and Hour Law?
The number of employees you have is not a factor in determining whether you are under the law. If you have only one or two employees and are engaged in any interstate activities, the law would apply.
Small independent retail establishments with annual business of less than $500,000.00 are exempt from the provisions of the law.
If you operate a chain of retail establishments and the chain as a whole has an annual volume of business of $500,000 or over, the individual retail outlets are subject to the law as is the central office and main warehouse.
If a retail enterprise ceases to be covered because of the increase of the dollar test, the employer cannot rely on their new lack of coverage to reduce compensation of employees who have been paid the minimum wage or stop paying overtime due to previously covered employees.
